Terms of Sale

These terms are an agreement between you and Nicholas Webster, trading as 3D Map Maker ("we", "us"), of [ADDRESS]. They apply to every map you order from 3dmapmaker.com. By placing an order you agree to them. If you do not agree, do not place an order.

Every map is made to order, to your own choice of place, size and settings. Once you have paid, you cannot cancel your order and you will not receive a refund, except where the map arrives faulty or damaged, as set out in section 8. Please read section 7 before you buy.

1. What you are buying

You are buying one 3D printed relief map of a piece of Great Britain. You choose the place, the area it covers, the way it is turned, its width and depth, its hill height and, if you wish, a route from a GPX file. We print the map to those choices, in coloured plastic, and post it to you.

Each map is made for you alone. It is not made until you have paid, and it is of no use to anyone else.

2. The preview is your final check

Before you pay, the site builds your map and shows you a 3D preview of it. The preview is drawn from the same model we print. What you see in the preview is what we make.

It is your responsibility to check the preview carefully before you pay: the place, the area, which way it faces, the size, the hill height and the route. Turn it round and look at it from every side. If anything is not what you want, change your choices and preview again. Do not pay until you are happy with it.

3. What the map is, and what it is not

Your map is made from open map data and aerial survey data published by others, as it stood when your map was built. That data is not perfect. It may be out of date, incomplete, or different from the ground as you know it. A wall, a track, a field boundary or a stretch of scree may be missing or in a different place. We do not survey the ground ourselves and we do not correct the data by hand.

You should also expect the following. None of them is a fault:

• Hills are raised by the hill height you choose, so slopes are steeper than in life.
• Detail too small to print at your chosen scale is left out, and small roads and streams are left out as the area grows.
• Each kind of ground is printed in one colour of plastic. The colours are the plastic's own and will look different from the colours on your screen.
• 3D printing leaves fine layer lines and small marks, especially on steep faces and where colours meet.
• The site's name is printed into the underside of every map.

The map is a decorative object. It is not a navigation aid. Do not use it to plan or find your way on the hill.

4. Price and payment

The price is shown on the site before you preview and again before you pay. It includes VAT where VAT applies , and delivery to a UK address by Royal Mail Tracked 24.

Payment is taken by Stripe on its own secure page. We never see or hold your card details.

We deliver to addresses in the United Kingdom only.

5. When the contract is made

The contract between us is made when your payment is confirmed. We will then email you a receipt with a picture of your map.

If, after you have paid, we find we cannot make your map (for example because of a technical fault we cannot fix), we will tell you and refund everything you paid. That is the only case in which we cancel an order.

6. Making and delivery

We aim to print and post your map within [X] working days of payment. This is an aim, not a promise. A large map can take several days to print.

We post by Royal Mail Tracked 24 to the address you give us. The map becomes your responsibility once it is delivered to that address.

It is your responsibility to give a correct and complete delivery address. If a map is returned to us or lost because the address you gave was wrong or incomplete, we will post it again only if you pay the postage again. We will not reprint it or refund you.

If Royal Mail's tracking shows your map lost in the post, contact us and we will print and send another at no cost to you.

7. No cancellation and no refunds

Your map is made to your specifications and is personalised to you. For this reason the 14-day right to cancel that applies to many online purchases does not apply to it. This is set out in regulation 28(1)(b) of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

Once you have paid:

• You cannot cancel your order.
• You cannot change the place, area, direction, size, hill height or route.
• You cannot return the map for a refund.

We will not give a refund, in whole or in part, for any of these reasons, among others:

• You have changed your mind, or no longer want the map.
• You chose the wrong place, area, direction, size, hill height or route.
• The map shows what the preview showed, and you do not like it.
• The map data differs from the ground as you know it, as described in section 3.
• The colours look different from those on your screen.
• The map took longer to arrive than you hoped.
• You gave a wrong or incomplete delivery address.
• The map was damaged after it was delivered to you.

By paying, you confirm that you have checked the preview and that you understand you are giving up any right to cancel.

8. Faulty or damaged maps

Your legal rights are not affected by these terms. The law says goods must be of satisfactory quality, fit for purpose and as described.

If your map arrives broken, damaged in the post, or with a printing fault, such as a part missing or coming away, or a clear difference from your preview, contact us within 14 days of delivery. Send photographs of the map and of the packaging.

We will print your map again and send it to you at no cost. If we cannot, we will refund the price you paid. We may ask you to return the faulty map.

A difference between the map data and the ground, as described in section 3, is not a fault.

9. Routes you upload

If you upload a GPX file, you confirm it is yours to use. We use it only to place and draw the route on your map.

10. Use of your map

Your map is for your own personal use, including as a gift. You must not copy it, scan it, or make and sell copies of it.

The map data comes from third parties under their own open licences. Their credits are on the site and with your map.

11. Our liability

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited.

Subject to that, our total liability to you for any order is limited to the price you paid for it. We are not liable for any loss that was not foreseeable, for any loss arising from use of the map as a navigation aid, or for any business loss. Our maps are sold for personal use only.

12. The site

The site is provided as-is. We do not promise it will always be available, or that every place in Great Britain can be printed. Where there is no suitable survey data, the site will not offer a map.

We may change, suspend or withdraw the site, or any part of it, at any time. This does not affect an order you have already paid for.

13. Changes to these terms

We may update these terms. The terms that apply to your order are the ones on the site when you paid. The current version is always available here.

14. Governing law

These terms are governed by the laws of England and Wales, and disputes are subject to the jurisdiction of its courts. If you live in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
